1. Acceptance of Terms

Welcome to SkyPeak Treks. By accessing and using our website and services, you agree to be bound by these Terms of Service. These terms apply to all visitors, users, and others who access or use our mountain hiking tour services. If you disagree with any part of these terms, please do not use our services.

2. Service Description

SkyPeak Treks provides professional mountain hiking and trekking tour services in Canada. Our services include:

  • Guided mountain hiking tours for various skill levels
  • Professional outdoor equipment rental
  • Safety training and wilderness education
  • Custom expedition planning and coordination
  • Photography services during tours

All services are subject to availability and may be modified or discontinued at our discretion with reasonable notice.

3. Booking and Payment

Tour bookings must be made through our official website or by contacting our office directly. A deposit is required to secure your reservation, with the balance due according to the specified payment schedule. Accepted payment methods include credit cards, debit cards, and bank transfers. All prices are in Canadian Dollars (CAD) and are subject to applicable taxes.

We reserve the right to cancel any booking if payment is not received by the specified deadline. In such cases, your deposit may be forfeited according to our cancellation policy.

4. Cancellation Policy

Cancellations must be submitted in writing via email to [email protected]. The following cancellation terms apply:

  • More than 30 days before tour date: Full refund minus 10% administrative fee
  • 15-30 days before tour date: 50% refund
  • Less than 15 days before tour date: No refund
  • No-show or failure to complete tour: No refund

SkyPeak Treks reserves the right to cancel tours due to weather conditions, safety concerns, or insufficient bookings. In such cases, clients will receive a full refund or the option to reschedule.

5. Participant Requirements

All tour participants must meet the following requirements:

  • Be in good physical health appropriate for the chosen tour difficulty level
  • Complete and sign a liability waiver before participating
  • Disclose any medical conditions that may affect their participation
  • Follow all instructions provided by tour guides
  • Carry valid identification and emergency contact information
  • Minors must be accompanied by a parent or legal guardian

We reserve the right to refuse service to anyone who does not meet these requirements or whose behavior poses a risk to themselves or others.

6. Liability and Risk Acknowledgment

Mountain hiking involves inherent risks including, but not limited to, injury, illness, property damage, or death. By participating in our tours, you acknowledge these risks and agree to assume full responsibility for your participation. SkyPeak Treks, its employees, and guides are not liable for any injuries, losses, or damages except in cases of proven negligence or willful misconduct.

We strongly recommend that all participants obtain comprehensive travel and adventure sports insurance coverage before participating in any tour.

7. Intellectual Property

All content on the SkyPeak Treks website, including text, graphics, logos, images, and software, is the property of SkyPeak Treks and is protected by Canadian and international copyright laws. Unauthorized use, reproduction, or distribution of this content is strictly prohibited.

Photos and videos taken during tours may be used by SkyPeak Treks for marketing purposes unless participants explicitly opt out in writing.

8. Privacy and Data Protection

Your privacy is important to us. Personal information collected during the booking process is used solely for tour administration and communication purposes. 9. Code of Conduct

All participants must conduct themselves in a respectful manner toward guides, other participants, and the natural environment. Prohibited behaviors include:

  • Harassment or discrimination of any kind
  • Damaging or removing natural features
  • Littering or polluting the environment
  • Consuming alcohol or illegal substances during tours
  • Ignoring safety instructions or wandering away from the group

Violation of these guidelines may result in immediate removal from the tour without refund.

10. Force Majeure

SkyPeak Treks is not responsible for failure to perform services due to circumstances beyond our reasonable control, including natural disasters, extreme weather, government restrictions, pandemics, or other acts of God. In such cases, we will work with clients to reschedule tours or provide appropriate refunds.

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

12. Governing Law

These Terms of Service are governed by the laws of British Columbia, Canada. Any disputes arising from these terms or use of our services shall be subject to the exclusive jurisdiction of the courts in British Columbia.

14. Severability
